XMP is required to get the speeds listed on RAM. The only times I've seen people have issues with warranties with XMP was with certain prebuilts which they could have just said they didn't use it. Most components are covered even when overclocking. I've even sent CPU's back for bad overclocking ability and gotten new ones. Sent ram back that was unstable at the advertised OC. etc.
