This is a fairly common situation at the moment. People simply "click" the contract without reading it (it's too much work for them and usualy long text). If something happen, they will start attacking the service provider - usualy about 90% wrongful. If the backup of your data was not explicitly noticed in the contract, the provider is simply not responsible for its lossing.
