Not sure why you're being attacked, OP. Regardless of if it's stated in their terms, them losing your data is messed up. If they're getting paid, they should make backups.
This isn't how anything works.
The company I work with hosts websites and intranets for our clients. Clients that pay the regular $50/mo get basic Co-Lo hosting with no back-up system. The onus is on them to develop that on their own, unless they hire one of our people or someone else to make one for them, or pay a higher hosting fee to have scheduled backups. We tell this to them very clearly at the get-go. About a third of our clients are 'cheap'. When they do something on their end that ♥♥♥♥♥ up their website, then complain why their site wasn't backed-up, we tell them it's because they paid for basic hosting. We even show them the contract in which we circled the terms of service, with their initials beside it.
Just because a company is getting paid for something, doesn't mean they are responsible for everything under the sun. You want the company to backup your stuff? Then read the terms and see if there are backup systems that can be bought. No? Then go with another hosting service.

TLDR: You are responsible for reading the terms of service. Just because you paid someone to host it, doesn't mean they are responsible for a service they're not providing.
